Legal Adviser (Distribution), Dublin        Salary €65,000 - 85,000

Duties and responsibilities

  • Take responsibility for all legal and regulatory issues affecting the distribution of product range on the basis of completed fund documentation
  • Draft / supervise the drafting of country specific fund 'wrappers', application forms, sales agreements, reciprocal distribution agreements, Agreements with third parties supporting sales administration, Website/ sales documentation disclaimers and legal information
  • Support distributor/ sales administrator compliance with Money Laundering, tax reporting obligations, statutory rights of investors including literature fulfilment, customer complaints, cooling off, data protection, distance selling restrictions etc.
  • Liaise with external counsel, regulators and other third parties to ensure compliance by the Distribution division with international and local law and regulation
  • Maintain an up to date knowledge of all developments in EU and International Funds Law and Regulation from an EU to country level having particular regard to developments in consumer protection legislation
  • Advise on conduct of business and regulatory status of offices in the 11 countries where the International Division has a presence.
  • Legal approval for marketing materials for all entities in the International Division.
  • Advise on and draft distribution agreements for offices in the International Division
  • Participate in product development process on distribution issues.
  • Advise on KYC andanti-money laundering processes.

 

Experience and Qualifications

  • An Irish or other European legal training
  • International experience of the legal and regulatory issues affecting the distribution of UCITS and other collective investment vehicle structures in Europe
  • Competence in a second European language a distinct advantage.
